Please read these Terms of Service ("Terms") carefully before using the Akra Field mobile application (the "App") operated by Akra LLC ("we," "our," or "us").
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
1. ELIGIBILITY
The App is intended for use by adults (18 years or older) working in professional construction settings. By using the App, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.
2. ACCOUNT REGISTRATION
To use the App, you must create an account by providing accurate and complete information, including your email, name, company, and role. You are responsible for:
• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
3. ACCEPTABLE USE
You agree to use the App only for lawful purposes related to construction field operations. You agree NOT to:
• Provide false or misleading information
• Harass, threaten, or intimidate other users
• Upload malicious content, viruses, or harmful code
• Attempt to gain unauthorized access to the App or other users' accounts
• Use the App for any illegal purpose
• Violate any applicable laws or regulations
• Interfere with or disrupt the App's functionality
4. USER CONTENT
You retain ownership of content you create in the App (logs, notes, photos, messages, etc.). By using the App, you grant us a limited license to store, display, and transmit your content as necessary to provide the App's functionality.
You are solely responsible for the content you create and share. You represent that your content:
• Is accurate and truthful
• Does not violate any third party's rights
• Complies with all applicable laws and regulations
5. INTELLECTUAL PROPERTY
The App, including its design, features, and code, is owned by Akra LLC and protected by intellectual property laws. You may not:
• Copy, modify, or distribute the App
• Reverse engineer or attempt to extract the App's source code
• Use our trademarks or branding without permission
6. PUSH NOTIFICATIONS
The App may send push notifications for messages, task assignments, reminders, and other updates. You can disable notifications through your device settings at any time.
7. DISCLAIMER OF WARRANTIES
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY OF CONTENT
We do not warrant that the App will be uninterrupted, error-free, or secure.
8. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AKRA LLC SHALL NOT BE LIABLE FOR ANY:
• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES
• DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE APP
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO USE THE APP (IF ANY) IN THE TWELVE MONTHS PRECEDING THE CLAIM.
9. INDEMNIFICATION
You agree to indemnify and hold harmless Akra LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
• Your use of the App
• Your violation of these Terms
• Your violation of any third party's rights
10. TERMINATION
We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. You may stop using the App at any time.
Upon termination:
• Your right to use the App ceases immediately
• We may delete your account and data
• Provisions that should survive termination will remain in effect
11. CHANGES TO TERMS
We may update these Terms from time to time. We will notify you of significant changes through the App or via email. Continued use of the App after changes constitutes acceptance of the updated Terms.
12. GOVERNING LAW
These Terms are governed by the laws of the State of Ohio, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Ohio.
13. SEVERABILITY
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
14. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Akra LLC regarding the App.
